Chapter-I

INTRODUCTION

Criminal Justice System refers to judicial process or procedure of adjudicating criminal issues of which depends on vast knowledge in the Criminal matter and its practice. Easily it may be said Criminal Justice in concerned with the punishment of the wrong other than civil wrong which in Criminal Proceeding is known as crime. Prosecutors are an unavoidable organ in the investigation of crimes as well as presenting the case before courts in the French Criminal Justice system which is basically inquisitorial or continental criminal justice model. The Code of Criminal Procedure, 1958 is known as Code d’ Instruction Criminelle in the French language. The crimes or offences are also named separately like crimes, delits, correctionells and contraventions. Public Prosecution is known as exercise de l’action publique. Many of the basic laws of Bangladesh such as penal code, civil and criminal procedural codes, contract law and company law are influenced by English common laws. An inquisitorial system is a legal system where the court or a part of the court is actively involved in investigating the facts of the case, as opposed to an adversarial system where the role of the court is primarily that of an impartial referee between the prosecution and the defense. Inquisitorial systems are used primarily in countries with civil legal systems as opposed to common law systems.
